Your privacy is important to us and we are committed to ensuring it is protected.  We do not usually collect information through this website.  If for any reason we do collect information such as your email address, through your use of this website, then such information will be collected and used for our internal purposes only.

Our privacy policy applies to the collection, use and disclosure of personal information by Talbot Olivier and the right to access and collect that confirmation.  A copy of our privacy policy is set out below.

Privacy Policy

Talbot Olivier and entities controlled by it (collectively referred to as Talbot Olivier, “we”, “our” and “us”) abide by the National Privacy Principles established under the Privacy Amendment (Private Sector) Act, 2000.

1.    Information We Collect

Talbot Olivier will predominantly collect personal information directly from clients and prospective clients, which is necessary for its activities as a legal services provider. 

To provide comprehensive legal services, it may also be necessary for us to collect a broad range of personal information from other parties to a matter, persons who can assist in our assessment and conduct of a matter, relevant government agencies, courts tribunals, suppliers and prospective employees.

This personal information may include:

  • Health information
  • Sensitive information
  • Financial information
  • Information about persons who have an involvement in the matter, but who are not the client, instructing us

The collection of some personal information may be required by legislation or by an order of a court or tribunal.

Failure to provide the necessary personal information may affect the adequacy or appropriateness of the legal services we provide.

We also collect personal information from people interested in working for Talbot Olivier as a member of staff, from suppliers or contractors involved in the provision of corporate and other support services to Talbot Olivier.

Where information is provided to us about someone else (such as one of your directors or employees or someone with whom you have dealings) you must ensure that you are entitled to disclose that information to us and that we may use and disclose such information for the purpose it was disclosed to us. 

We suggest that you take reasonable steps to ensure that the individual is aware of the matters detailed in the Talbot Olivier Privacy Statement. 

2.    Use and Disclosure

Talbot Olivier will only use or disclose personal information for the purpose for which it was collected or for the purpose that is reasonably expected or with consent.

We will use personal information as is necessary for us to properly assess the instructions, provide legal services requested and, where relevant, to monitor current and future legal needs.

3.    Data Quality

Talbot Olivier will use reasonable endeavours to ensure that the personal information it collects, uses or discloses is accurate, complete and up to date.

4.    Data Security

Talbot Olivier will take all reasonable steps to protect the personal information it holds from misuse and loss and from unauthorised access, modification or disclosure.

Further, Talbot Olivier will take reasonable steps to destroy or permanently de-identify personal information if it is no longer needed for any purpose for which the information may be used or disclosed under National Privacy Principle 2.

5.    Openness

Upon request, and subject to reasonable notice, we will allow you access the information we have about you.  A reasonable access fee may be charged to cover the costs of providing the information to you.

6.    Access & Correction

Talbot Olivier will provide access to personal information about an individual in accordance with the requirements of the National Privacy Principals.

If information necessary for the purpose for which it was obtained is established not to be accurate, complete and up to date then Talbot Olivier will take steps to correct, complete or up date the information.

We also collect and use personal information for business development, planning and marketing of our services.  We also use information collected from events that we hold or participate in to provide information about legal and related issues and news about Talbot Olivier and the services we provide.  We will not give your personal information to any other organisation for marketing purposes.

We may be required by law or by an order of a court or tribunal to disclose your personal information to others.  The Privacy Act allows us to disclose personal information about you for purposes relating to public safety and law enforcement.

7.    Identifiers

Talbot Olivier will not adopt or disclose a Commonwealth Government identity number which has been allocated except in accordance with the requirements of the National Privacy Principles.

8.    Anonymity

It is unlikely that Talbot Olivier will receive instructions from an anonymous client or other persons, as this would probably not enable us to properly assess legal issues concerned.

9.    Transborder Data Flows

We may transfer your personal information to foreign countries where the transfer is expressly or impliedly for your benefit or necessary for your business.

10.   Sensitive Information

Where the health of a person (whether or not they are represented by Talbot Olivier), is relevant to a legal matter we are acting on, we may need to obtain personal information from an individual’s doctor and other health professionals and health services providers.  Talbot Olivier will not use or disclose personal information collected for a purpose other than that for which it has been provided or reasonably expected unless we have received the consent of the individual concerned.
